These Terms of Use (“Terms”) govern your access to and use of the KAVACH platform, including our websites, web applications, mobile applications, APIs, and related services (collectively, the “Service”).
The Service is operated by Pipe Dream eSolutions OPC Private Limited, an Indian company (“KAVACH”, “we”, “us”, “our”).
By creating an account, accessing, or using the Service, you (“you”, “User”) agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. About the KAVACH Service
1.1 Purpose
KAVACH provides a digital platform for creators (including artists, designers, photographers, writers, developers and other creative professionals) to:
- Upload files and associated metadata.
- Generate cryptographic hashes and server side timestamps for those files.
- Obtain certificates and records that can be used as technical evidence of prior existence and association with a particular account.
1.2 No Grant of Legal Rights
KAVACH does not:
- Grant or register copyrights, patents, trademarks, designs, or any other formal intellectual property rights.
- Replace statutory registration systems or official IP offices.
The Service is designed to support your legal position by creating and preserving digital evidence; it is not a substitute for legal registration with government authorities or professional legal advice.
1.3 No Legal Advice
Nothing in the Service, including certificates, reports, or communications from us, constitutes legal advice. You should consult a qualified lawyer in your jurisdiction for legal advice or representation.
2. Eligibility and Account Creation
2.1 Eligibility
You may use the Service only if:
- You are at least 18 years old or the age of legal majority in your jurisdiction, and
- You have the legal capacity to enter into a binding contract and are not barred from using the Service under applicable law.
2.2 Account Registration
To use certain parts of the Service, you must create an account and provide accurate, complete registration information (such as name, email address, password, and country). You agree to:
- Keep your information up to date.
- Maintain the confidentiality of your credentials.
- Notify us immediately of any unauthorized use of your account.
You are responsible for all activities under your account.
2.3 Representatives and Organizations
If you are using the Service on behalf of a company, agency, studio, or other entity, you represent and warrant that you are authorized to bind that entity to these Terms. In that case, “you” and “User” will also refer to that entity.
3. Plans, Pricing and Billing
3.1 Plan Types
We may offer different plans, for example:
- Free plan – limited uploads and features.
- Pro plan – higher limits and additional features.
- Studio plan – premium features for heavy users or teams.
Details (upload limits, storage caps, features, prices, and regions) are described within the Service or on our website and may change from time to time.
3.2 Fees and Taxes
- Plan fees are shown in the currency indicated for your region (e.g., INR, USD, EUR).
- Prices may be exclusive of applicable taxes (such as GST, VAT), which will be added where required.
- You are responsible for all taxes associated with your purchase, except taxes on our income.
3.3 Billing and Renewals
- Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually) until cancelled.
- By providing a payment method, you authorize us and our payment processors to charge the applicable fees and taxes on a recurring basis.
- If billing fails, we may suspend or downgrade your account until payment is resolved.
3.4 Changes to Plans and Prices
We may modify plan features and pricing at any time. For existing subscribers:
- We will provide reasonable prior notice of material changes (e.g., via email or in app notifications).
- Changes will generally apply from the next renewal period.
3.5 Cancellation and Refunds
- You can cancel your subscription at any time via your account settings or app store/platform used for purchase.
- Your plan remains active until the end of the current billing period; no partial refunds for unused time unless required by law or explicitly stated by us.
- Our detailed Cancellation and Refunds Policy is incorporated by reference into these Terms and may be updated periodically.
4. Content and Intellectual Property
4.1 Your Content
“Content” means any file, image, text, audio, video, design, code, metadata, or other material you upload, transmit, store, or generate through the Service.
You retain all ownership rights in your Content. KAVACH does not claim ownership over your original works.
4.2 Licence to KAVACH
To operate the Service, you grant KAVACH a limited, worldwide, non exclusive, royalty free licence to:
- Store, host, and back up your Content.
- Process your Content to generate hashes, timestamps, certificates, thumbnails, and logs.
- Display your Content to you within your account and, where you explicitly choose, via shareable links or public views.
- Use anonymized or aggregated data (not directly identifying you) to improve and analyze the Service.
This licence exists only for the purpose of providing and improving the Service and ends when your Content is deleted from our systems, subject to technical and legal retention requirements.
4.3 Your Responsibilities
You are solely responsible for:
- Ensuring you have all necessary rights to upload and use your Content.
- The legality, accuracy, and completeness of your Content.
- Making and maintaining your own backups of your Content outside of KAVACH (we provide backups for reliability but do not guarantee against all loss).
4.4 Prohibited Content
You must not upload, share, or store Content that:
- Infringes any third party intellectual property or privacy rights.
- Contains illegal material (e.g., child sexual abuse material, extremist content, incitement to violence).
- Contains malware, viruses, or harmful code.
- Violates confidentiality or trade secret obligations that you are bound by.
We may remove or disable access to Content believed to be illegal, infringing, or in violation of these Terms, and may suspend or terminate your account where appropriate or required by law.
5. Use of the Service
5.1 Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Attempt to gain unauthorized access to any part of the Service or related systems.
- Interfere with or disrupt the Service or any server or network connected to the Service.
- Circumvent or attempt to circumvent any security or access control features.
- Misrepresent your identity or affiliation in any way.
5.2 Automation and API Use
If we offer APIs or automation features:
- You must follow any applicable API documentation, quotas, and rate limits.
- You must not abuse or overload the Service with automated requests.
6. Evidence, Certificates and Legal Use
6.1 Nature of Evidence Provided by KAVACH
KAVACH provides:
- Cryptographic hashes of your uploaded files.
- Recorded server time timestamps associated with those hashes and your account.
- Evidence certificates summarizing these records.
These are technical records that can be used as supporting evidence of prior existence and association, but they do not, by themselves, constitute legal registration or guarantee any particular outcome in a dispute.
6.2 Admissibility and Weight of Evidence
- Courts, authorities, platforms, and arbitral bodies have their own rules regarding the admissibility and evidentiary weight of digital records and timestamps.
- While timestamped records and similar systems (including WIPO PROOF and blockchain based proofs) have been recognized as useful supporting evidence in various jurisdictions, we cannot guarantee that any particular body will accept or give specific weight to KAVACH records.
6.3 No Guarantee of Priority or Ownership
KAVACH timestamps show that a file was associated with your account at a particular time. They do not:
- Automatically prove that you are the original creator.
- Automatically prove that no earlier versions exist elsewhere.
- Prevent others from independently creating similar works.
Your legal strategy should combine KAVACH records with other evidence (drafts, communications, contracts, platform logs, etc.).
7. Privacy and Data Protection
7.1 Privacy Policy
Our processing of personal data is described in our Privacy Policy, which forms part of these Terms. It explains what data we collect, how we use it, how we share it, and your rights.
7.2 DPDP (India) and Other Laws
For Indian users, we also provide a DPDP Policy addressing the Digital Personal Data Protection Act, 2023. For EU/UK and other jurisdictions, we seek to comply with applicable data protection laws (such as GDPR) as appropriate, but specific rights and obligations may vary by region.
8. Security
8.1 Our Measures
We use reasonable technical and organizational measures designed to secure your data, including:
- Encryption in transit and at rest where appropriate.
- Access control and logging.
- Regular backups and redundancy.
8.2 Your Responsibilities
You must:
- Keep your login credentials confidential.
- Use strong passwords and enable any additional security mechanisms we offer (e.g., 2FA, when available).
- Notify us promptly if you suspect unauthorized access to your account.
We cannot be responsible for loss or damage arising from your failure to follow these obligations.
9. Third Party Services and Links
The Service may include integrations or links to third party services (e.g., payment processors, AI tools, reverse image search providers, analytics). We do not control and are not responsible for:
- The content, privacy practices, or terms of those third party services.
- Any damages or losses caused by your use of third party services.
Your use of third party services is governed by their own terms and policies.
10. Suspension and Termination
10.1 Our Rights
We may suspend or terminate your access to the Service, in whole or in part, if:
- You materially breach these Terms or applicable law.
- Your use poses a security risk or may subject us or others to liability.
- We are required to do so by law or competent authority.
- You fail to pay applicable fees after reasonable notice.
10.2 Effect of Termination
Upon termination:
- Your right to use the Service ends.
- We may delete or restrict access to your account and Content, subject to legal and contractual retention obligations.
- Where feasible and lawful, we may allow read only access to previously generated certificates for a limited time, to avoid prejudice in ongoing disputes; this is not guaranteed and should be discussed with counsel for critical matters.
10.3 User Initiated Deletion
If you request full deletion of your account and Content, we will act in accordance with our Privacy and DPDP policies and applicable law. Deleting Content may irreversibly destroy evidence; this is your responsibility and should be carefully considered.
11. Disclaimers
To the maximum extent permitted by law:
- The Service is provided “as is” and “as available”, without warranties of any kind (express, implied, statutory), including warranties of merchantability, fitness for a particular purpose, non infringement, or accuracy.
- We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that any defects will be corrected.
- We do not guarantee any legal or commercial outcome based on use of the Service.
12. Limitation of Liability
To the maximum extent permitted by law:
- KAVACH, the Company, its directors, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profit, revenue, data, goodwill, or business opportunity arising out of or in connection with the Service or these Terms.
- Our total aggregate liability for all claims relating to the Service in any 12 month period is limited to the greater of:
- (a) INR 10,000; or
- (b) the total amount you have paid to us for the Service in that 12 month period.
13. Indemnification
You agree to indemnify, defend, and hold harmless KAVACH, the Company, and its affiliates, officers, directors, employees, and agents from and against all claims, damages, obligations, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use or misuse of the Service.
- Your Content.
- Your violation of these Terms.
- Your violation of any law or third party rights.
14. Changes to These Terms
We may update these Terms from time to time. When we do:
- We will post the updated Terms and update the “Last updated” date at the top.
- For material changes, we will provide reasonable additional notice (e.g., via email or prominent in app notice).
If you continue to use the Service after changes take effect, you will be deemed to have accepted the updated Terms.
15. Governing Law and Dispute Resolution
15.1 Governing Law
Unless mandatory local law requires otherwise, these Terms are governed by the laws of India, without regard to conflict of law principles.
15.2 Dispute Resolution
- Parties will first attempt to resolve disputes amicably through good faith negotiations.
- If unresolved within a reasonable period (e.g., 30 days), disputes may be submitted to mediation or arbitration where both parties agree, including options such as WIPO ADR for digital copyright disputes.
- Subject to the above, courts of Vijayawada, AP, India will have exclusive jurisdiction.
16. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy, DPDP Policy, Cookie Policy, and Cancellation & Refunds Policy, constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
